Dear Mr/Ms .................,
You have been unfit for work for more than 6 weeks within the last 12 months. In order to make it easier for you to reintegrate into the work process after a longer or repeatedly shorter period of illness and to prevent you from being unable to work again, the legislator provides suitable support in the form of company integration management (BEM) in accordance with Article 167 para. 2 of Social Code Book IX (SGB IX).
Together we will discuss in a personal meeting which conditions at your workplace can be changed and which other suitable measures can be taken to speed up your recovery and prevent you from being unable to work again.
We therefore offer you a non-binding initial consultation. You can decide for yourself whether to accept the offer of an interview and decide who should take part in the interview. In particular, you can nominate a person you trust who can accompany you during the proceedings. In addition to you and a representative of the employer (Mr/Ms ...), the company doctor if required and, at your request, a representative of the works council will also take part in the interview.
Alternativ
Optional: Schwerbehindertenvertretung hinzuziehen
In the case of severely disabled persons, the representative body for severely disabled persons must also be consulted.
The BEM is voluntary and the rejection of a BEM procedure has no direct negative consequences for you. However, if you refuse, you will miss the opportunity to recognise and take action to maintain, improve or restore your ability to work. All those involved in the BEM are subject to a duty of confidentiality.
This letter of invitation, your declaration of approval or rejection of the BEM and, if a BEM is carried out, a note on the completion of the BEM will be placed in your personnel file.
All other documents and data (e.g. notes, memos and minutes of discussions) that are generated during the implementation of a BEM are not included in your personnel file and must be stored during the BEM in such a way that data protection and data security are ensured. This only applies if you expressly consent to the documentation of these documents and data.
For the time being, if you consent to the counselling interview, only the following data will be collected and stored and used for the purpose of the BEM:
- Your full name
- Your date of birth
- Your training and qualifications
- Your start date in our company
- The department/cost centre to which you currently belong
- Your current or last job in our company
- Extent and location of your regular working hours
- Your possible severe disability or equalisation
- Your sickness-related absences in the past few years
- Data on the course and outcome of the BEM or the counselling interview
Which further data is collected and then processed in the course of a BEM depends very much on the individual case and would always have to be agreed intensively between us in the course of the BEM, whereby you alone decide on this. For each individual phase of the BEM, you will be able to voluntarily specify which data collection and use you agree to and which you do not.
Please let us know
- within 2 weeks in writing using the enclosed reply letter or by e-mail, whether you wish to accept the offer of a non-binding initial consultation or whether you wish to forego the consultation.
- within 2 weeks in writing or by e-mail whether you consent to the processing of the above-mentioned data. If you do not give your consent, the BEM cannot take place!
Even in the event of a waiver, the BEM can be taken up at a later date at any time at your request.
We would be pleased to receive positive feedback and will be happy to answer any questions you may have.
Yours sincerely
